APPROVAL OF MINUTES. On the motion and second of Commissioner Bristol and Welsh, the minutes of the August 1, 2007 meeting were approved as amended. On the motion and second of Commissioner Bristol and Chair Junor, the minutes of August 15, 2007 were approved as written. Commissioner Welsh abstains.

ISSUE CONTRACT – LANDSCAPE MAINTENANCE SERVICES (ASR 07-001937) Assistant Airport Director requested Airport Commission concurrence with the recommended Board action to issue a contract with TruGreen Land Care for landscape maintenance services in the amount not to exceed $1,324,715, effective September 11, 2007 through September 10, 2010. Assistant Director Loan Leblow explained that a second bidding process was necessary after the Board of Supervisors had awarded the contract, when the apparent low bidder was unable to fulfill the bonding requirements; unfortunately, the second bidding process offered substantially higher bids. The Airport reverted to TruGreen Land Care, which was the second low bidder for the initial bidding process. TruGreen Land Care has honored the initial bid and accepted the terms and conditions for a three (3) year contract with a two (2) year option to renew. Responding to Vice Chair Bristol, Assistance Director Leblow stated that the scope is substantially the same, with the exception of a full bonding requirement, as opposed to the 10% requirement of the first. Responding to Chair Junor, Assistant Director Leblow clarified that the original apparent low bidder did not have access to the Airport due to the failure to comply with bonding requirements, thus creating a lapse in landscape maintenance services. Deputy Airport Director Larry Serafini noted that unlike Public Works Contracts that require bid bonds, Service Contracts do not. Responding to Chair Junor and Commissioner Welsh, Deputy Airport Director Serafini explained that leased Airport property and the slope along Route 73 are not covered by this contract, respectively.
On the motion and second of Vice Chair Bristol and Chair Junor, Item 2 was passed unanimously.

APPROVE AIRCRAFT NOISE MONITOR LEASE (ASR 07-001901) Assistant Airport Director requested Airport Commission concurrence with the recommended Board action to approve an Aircraft Monitor Lease, for an annual rent of $1,800 that allows for the continued operation of a noise monitoring system at 17952 Beneta Way, Tustin, California. Assistant Airport Director Leblow stated that this monitor is located on Tustin Unified School District property. Due to delays from the TUSD, this request is retroactive to July 1, 2007. Assistant Director Leblow also noted that unlike other noise monitor leases that encompass a ten (10) year period, TUSD policy restricts leases to a five (5) year period.
